SC Dismisses Plea Seeking Scrapping of Justice BS Chauhan- Led Panel to Probe Vikas Dubey Encounter
A bench comprising of Justice SA Bobde, Justice AS Bopanna and V. Subramaniun on Wednesday dismissed an application which was seeking the disbanding of the (retd.) Justice BS Chauhan inquiry commission constituted by the Supreme Court to probe the alleged encounter of Uttar Pradesh gangster Vikas Dubey.
In July this year the SC constituted the commission, the names of the members were suggested by the UP Government which includes (retd) Justice BS Chauhan, KL Gupta and Justice Sashi Kant Aggarwal.
The plea was filed by Ghanshyam Upadhyay, who also issued contempt proceedings against the State functionaries for allegedly suppressing true facts about the members of the commission, while the Apex Court reserved the order.
Upadhyay also questioned the integrity on the independence of the members of the Court appointed commission with regard to the recent facts of the case which came up in a media report.
The Apex Court said,
“We have provided some safeguards in the manner in which the probe is to be conducted. The plea has no merit and is accordingly dismissed”
CJI SA Bobde said,
“We will not allow you to level charges against a Judge on the basis of a newspaper report”
Upadhyay, with regard to the appointment of Justice BS Chauhan, alleged close connections of the Judge with the ruling BJP Government based on article published in ‘The Wire’ titled ‘Family Ties of Former DGP, SC Judge Cast Conflict of Interest Shadow on Vikas Dubey Probe’
The petition also stated that Shri KL Gupta, who is also in the commission, is related to the IG of Kanpur Zone, Shri Mohit Aggarwal, where the alleged encounter of Vikas Dubey took place and is also involved the fake encounters, therefore is bound to come under the scanner of the probe.
