Health is wealth is one of the most heard quotes in everybody’s lifetime. During this ongoing COVID-19 pandemic condition where life has become so unpredictable and uncertain health has taken the most important place over all the other motives or goals in life. Keeping all this mind Public Interest Litigation (PIL) were filed by parents and students from different part of country for the postponement of JEE MAIN and NEET 2020 exams.
Advocate Alakh Alok Srivastav was representing all these parents and students. Advocate referring to CBSE and ICSE exams and also taking into consideration postponement of AIBE exam, mentioned that we are anyways not looking for an indefinite postponement. While the second PIL demanded that there should be no further postponement of entrance exams.
In the plea petitioners seek the cancellation of exams scheduled to take place in September and demanded that they should be further rescheduled, adding to this demand was put forward to also increase the number of exam centres for conducting exams keeping in mind the overall goal of social distance. They demanded that each district should at least have one exam centre for smooth and safe conduction of exams. Further it was demanded that application portal should be reopened. An attempt was made to draw the attention of court to rising number of COVID-19 patients despite the fact that exams are scheduled for September.
It was said that students in lakhs appear for exams like NEET and JEE MAIN after spending a lot of their time in preparing for them. Amid the rising COVID-19 cases record in India which has crossed the bar of 20 lakh sufferers and deteriorating condition day by day, it might not prove to be good decision to conduct exam at such a large scale and putting life of lakh of students at risk by exposing them to infection although unintentionally.
PIL was heard by 3 bench judges including Justices Arun Mishra, Krishna Murari and BR Gavai. PIL is dismissed by Supreme Court.
The court observed that
“Life cannot be stopped we have to move ahead with all safeguards and all ……… are(students) you ready to waste one whole year?”

Furhter court stating the dismissal said that career of students can no longer put in doubt or jeopardy.
