INTRODUCTION
Marriage immigration Frauds are those frauds in which two people fake a marriage to get ” green card” or residency of that country in which the marriage is faked in. e.g. there is a person A who is a citizen of Canada and there is citizen of India B who gets married to B in Canada to get the citizenship of Canada. This marriage of not getting into a marriage bond but getting citizenship of Canada is an example of marriage immigration fraud. Any marriage done with an intention of getting permanent residence in another country is known as marriage immigration fraud. The trend of moving from India (especially) to Canada and Australia ,New Zealand is known to everyone. People from India go abroad for studies after 12 on student visa then they try to settle down there and after settling themselves they on by one settle their family there. Every student be it in Punjab or in Delhi always dream of pursuing their graduation or post graduation abroad and then their parents want them to settle down and live a life they always dreamt of. Although lifestyle in abroad is not that easy to live as they show in movies, but this trend is never ending now. Many Punjabi and Bollywood movies show how marriage immigration Frauds take place and how a
person gets a “green card ” in abroad. In this module we shall be able to understand more about marriage immigration frauds. When a person calls another to abroad to marry him or her when, the person who is the permanent resident of the country has to bear his expenses and any public expenses until 3 years of their marriage. If the other spouse involve in some illegal activity and is found guilty the permanent resident will have to bear all his or her expenses until 3 years of their marriage.
UNDERSTANDING THE CONCEPT AND CONSEQUENCES
Marriage immigration fraud as above-mentioned are fraudulent act of marriage done with an intention of getting permanent residence in foreign countries. A man in US also has pleases guilty for operating a fraud marriage racket. These frauds are very much prevalent in these days.
CONSEQUENCES
The person who is the victim of this fraud go through a major breakdown, they often do not believe that the person who has married them would commit some fraud with them . The people often face the below enumerated problems:
- Their self confidence start to fall
- They stop believing in marriage and relationships
- Their work and health is majorly affected by this breakthrough.
- They might end up trying to end up their life.
A study conducted by some research authority had stated that people who go through this breakdown often hurt other people emotionally as they think this is their way of feeling better.
When a person who is doubtful of someone’s marriage and think that anyone’s marriage is done with an intention to fraud them or anyone has actually faced a marriage immigration fraud shall report the case to immigrating authority. The authority looks into the matter personally and if someone is found guilty of the offence they take the following steps:
- Ban them from entering that country for a certain time period.
- Deport them back to their country
- Cancel their permanent residence ship
- At times a suit of immigration fraud is also filed under their country’s courts.
- Which may result in imprisonment for a time period.
This act of fraud is not only immoral but also illegal. There are many types of marriage immigration frauds they are enumerated below as:
- Where one pays another to marry and help in getting permanent residence
- Where one favours another and marries.
- Where one defrauds another and portrays that their marriage is legitimate
Countries like Australia, Canada and US mostly face this problem of marriage immigration frauds and they have formulated their lead and regulations to curb down the cases.
Sometimes the story also turns the other way around and the person who gets married to the permanent resident of any country abroad is left or is abounded. People are left alone in an unknown country also face these marriage immigration frauds. Although they can file case in the country where they had married but may not be provided with an adequate justice. There are cases where the person who has married to a permanent resident is murdered in abroad and their family members are not even aware of this fact that his or her spouse has commit this crime. These cases are very normal and prevalent in the society, although regulations are made but their fair implementation is still lagging behind. One must be aware of all the pros and cons of marrying a person, everything might look fancy and glittery but after commission of any act like this may turn their world upside down.
CONCLUSION
In this module all the aspects of marriage immigration fraud are discussed. The consequences of this fraud legally and mentally are made very clear. It is very important for one to understand that all marriage may not have a happy ending. Life is very unpredictable, and we always see the unexpected journey. The legal consequences of this fraud may end up in way which one may have never thought of. Therefore, it is always said that one must be made aware of their rights and also obligations when the enter into marriage. So that none of the spouse feel that they are frauded and also no act of fraud can take place. Implementation of existing laws for marriage immigration frauds are yet yet to be implemented in their strictness sense. Need for strict implementation of these laws are very much a need for the hour as these cases are not declining but are touching the heights of the sky .
