“DELHI HC DIRECTS DISTRICT JUDGE TO HEAR DELHI RIOT ACCUSED BAIL APPLICATION”

The Delhi HC has directed on Tuesday to district and sessions Judge , North-East Delhi to ensure that the application filed by the accused Shahrukh of Delhi Riots , seeking grant of bail is taken up for hearing with in two days of it being filed.

Acting upon on plea, the single bench judge of Justice Anu Malhotra was hearing the bail application which was filed by Shahrukh Pathan , he involves in the matter of allegedly opening fire on the police officer during the Delhi Riots in CAA protests on 24th Feb. 2020 and he is in a judicial custody now.

Pathan has been charged upon FIR No. 51/2020, P.S Jaffarabad, Under Sections 186/307/353 of the IPC, 1860 and sections 25 and 27 of the Arms Act.

The counsel appearing for the Pathan submitted that application has been filed seeking grant of bail before the sessions court but was not taken uo for hearing observing to the effect that there is no urgency in the matter.

He sought a direction to withdraw the present application seeking liberty to seek redressal before the Sessions Court.

Finally the Court dismissed the application and granted the liberty to the petitioner to seek a remedy before the sessions court.
