SC on Central Vista Project

A bench comprising of Justice, AM Khanwillkar, Justice Dinesh Maheshwari and Sanjiv Khanna which was hearing petitions raising several aspects related to the Environmental Clearance granted to the Central Vista Project.

Senior Advocate Shyam Divan appearing for the petitioners stated that in the writ petition about the issues related to the Environmental Clearance granted on 17th June.

There are several pleas before the Apex Court including, land use, Municipal laws, Environmental  Clearances and General Declarations and other issues.

The bench is hearing several pleas on the issue including those filed by activist Rajeev Suri and (retd) Lt Col Anuj Srivastava on various permissions given to the project by the authorities including the permission of the change of land use.

The petitioners before the Delhi High Court had raised questions on the ground that in involves change in the land use of the green area adjoining Rajpath and Vijay Chowk in in order to build new Parliament and government offices

The Court has decided to take up the Land Use plea first which seeks to quash the approval of the construction of the new Parliament by the Central Vista Committee.

The Court said,

“ The Court will first begin hearing of board issue regarding challenge to change the land use being contrary to the provisions of Delhi Development Act 1957”

The DDA had issued a public inviting objection against the proposed changes in the land use, objections were the raised on the basis that the proposal was ultra vires and beyond the powers of the DDA.

The petition further states the violation of Article 21 under which citizens have the right to enjoyment of wholesome life and the land use of the green area will deprive citizens of it.

In March the petitions pending in Delhi High Court was transferred to the Supreme Court.
