Supreme Court Orders CBI Inquiry in Sushant Singh Rajput’s Death Case

The Apex Court has given its verdict today in Sushant Singh Rajput case, which everyone was eagerly waiting for. The Supreme Court has  pronounce its verdict in favour of Sushant Singh.

A single judge bench  headed by Justice Hrishikesh Roy, announced his verdict on Chakraborty’s plea in a virtual hearing. The late Bollywood actor’s father KK Singh had filed a case with the Patna Police in which he accused Rhea Chakraborty of abetting his son’s suicide, keeping him in wrongful confinement, and defrauding him of crores of rupees .

The Bihar Police had booked Rhea and five others under IPC Section 306 (Abetment of suicide), Sec 341 (Punishment for wrongful restraint), Sec 342 (Punishment for wrongful confinement), Sec 380 (Theft in dwelling house), Sec 406 (Punishment for criminal breach of trust), and Sec 420 (Cheating and dishonestly inducing delivery of property).

 The court has given its decision of 35 pages in this hearing and said that the Bihar government is capable of recommending an inquiry.  Patna court’s FIR has been found correct by the court and ask the  Mumbai police to hand over all evidence collected so far to the investigating agency.

Both Bihar Police and Riya Chakraborty argued their case.  Riya Chakraborty said in the affidavit to transfer the actor’s case to Mumbai. She objected that

“Investigations in Bihar are totally illegal and such illegal proceedings cannot be transferred to CBI in the present manner by way of illegal executive orders. The Petitioner has no objection if the transfer of investigation to CBI is done in exercise of powers conferred upon this Hon’ble Court under Article 142 of the Constitution of India. Otherwise, the present transfer from Bihar Police to CBI as is done is totally without jurisdiction and contrary to law

At the same time, the Bihar government, in its reply filed in the Supreme Court, said that Sushant comes under the jurisdiction of Bihar Police to investigate the case. The CBI  argued in the Supreme Court that the Mumbai Police’s action to record the statements of 56 witnesses is not under backup of any law.

The court, while delivering its verdict, admitted that the Mumbai police had not conducted an inquiry in the case. The court has made it clear that CBI will now look into every matter related to this case and ask Mumbai police to assist them .
