Rajasthan Assembly Speaker challenges HC order on 19 congress MLA’s in SC

Rajasthan assembly speaker CP Joshi moves to Supreme Court challenging High Court decision delivered on 24 th July 2020 in context to Sachin Pilot and 18 other MLA’s.

He stated that this order is in violation with the previous judgement given by Supreme Court in 1992 in Kihoto Hollohan v. Zachillhu case, as per which Courts has no power to contradict or interfere with speaker’s power to settle a disqualification petition until he conveys a final decision on any such disqualification petition.

The Advocate Sunil Fernandes said that ‘HC order of July 24 is completely restraining the Speaker to perform his constitutional duties stated under Schedule 10 of Indian Constitution’.
