About Competition
The moto of the Judgment Writing Competition is to capture the art of decision-making in fledgling Law students and Masters striving to join reputable judicial services, as well as to reveal the dynamic position of Judges in society. The judgement writing competition involves a holistic approach to law in terms of theory and application. The legal arguments based on facts and circumstances, as well as legal precedents and reasoning, set the way for the formulation of judgments. We firmly feel that this competition is an attempt to create a platform for our country’s forthcoming bright legal minds to hone their advocacy abilities and demonstrate their legal expertise. The novelty of this competition is that it allows competitors to hone their drafting abilities and also allowing them to debate the constitutional legality of the laws under which the fact or case was performed.
PROPOSITION
India is the world’s most democratic and welfare country. Vinay Kumar is an HR professional at a reputable IT firm who come from a well-established family. He launched a YOUTUBE channel called ‘Creak Freek’ for entertainment purposes during the National Covid-19 lockdown. He used it to upload troll videos, movie reviews, news updates, and motivational videos on his channel, which quickly grew to 2.54 million subscribers. He also made more money from YOUTUBE than he did from his HR profession. In the Indian film industry, “SMS Film Factory”(herein after ‘Film Factory’) is one of the most well-known producers. In India, this film factory mostly distributed “blockbuster” films starring big-name actors. This producer has planned to release a cinematography named “Dark Side of Evil Witness” (Film Factory Holds all the copyright of this film) with a super hit hero’s cast on December 1, 2021. This film is expected to shatter all box office records and to become a smash blockbuster among Indian moviegoers.
The film was released on the specified date, and Vinay Kumar was disappointed after seeing it on FDFS, since it fell short of his expectations. He uploaded a 16min movie review video on Creak-Freek at 11 a.m., stating, “The movie doesn’t live up to expectations and should be ranked 1.5 out of 5“. This video went viral and was seen by over 2 million people in just two hours. Meanwhile, the film’s ticket sales has suffered a setback, and in reach of 10 days, the majority of theatre owners withdrew the movie from their theatres. Because of this, SMS Film factory faced by them was a huge loss more than Rs. 70 crores. Aggrieved by this review, SMS Film Factory filed a case against Vinay Kumar in Delhi High Court seeking compensation of Rs. 70 crores. The Film Factory contended that the failure and loss faced by them is due to the movie review in “Creak Freek”. Vinay Kumar opposed that his review was legal under SEC. 39 (b) & 52 (1) (a) (i) of The Copyright Act, 1957. So, that he is not liable to pay any compensation claimed by the film factory. Concurrently, SMS film factory filed a writ petition before this Hon’ble Supreme Court, challenging the Constitutional validity of review and criticism under The Copyright Act, 1957. The case is listed before you in the Hon’ble Supreme Court, and all parties are awaiting for your judgment addressing all the issues involved.
